Apex court to consider state's plea against BSY

New Delhi (DHNS): The Supreme Court on Tuesday agreed to consider after two weeks a petition filed by the Karnataka government against a high court order that quashed the sanction for prosecution of former chief minister B S Yeddyurappa in land scam cases.

Additional Advocate General Devdutt Kamat pointed out before a bench of Justices J Chelameswar and S Abdul Nazeer that the state government has also filed a special leave petition in the matter, which should be heard with a similar plea made by a private person. The court put the matter for consideration after two weeks on a request made by a counsel, representing Sirajin Basha, the private person. Basha had challenged the High Court of Karnataka order of November 2015, which had quashed the sanction by previous Governor Hansraj Bhardwaj for prosecution of Yeddyurappa.

He also sought direction for transfer of a pending writ petition before the high court challenging Governor Vajubhai Vala’s order of December 4, 2015, who too subsequently declined the sanction for prosecution of Yeddyurappa. In a fresh move, the Karnataka government joined the petitioner, challenging the high court’s order.

The high court had in November 2015 cited “uneasy relationship” between the then chief minister Yeddyurappa and the then Governor Bhardwaj and set aside the January 21, 2011 sanction. It had also noted that the Governor did not advert to the advice of the Council of Ministers in granting permission for prosecution of the senior BJP leader in five cases of land denotification.

Yeddyurappa had claimed that Bhardwaj had acrimonious relation with him and the complainant, being associated with a rival political party, just walked into the Raj Bhavan and got sanction without following the due process of law.
