New Delhi, DHNS: The Supreme Court was informed on Monday that a complaint has been filed before a trial court against former Karnataka chief minister B S Yeddyurappa for action in land scam cases. Senior advocate Gopal Subramaniam apprised a bench of Justices J Chelameswar and Abhay Manohar Sapre that complaint was submitted before the trial court even though the Governor has denied sanction for prosecution of the senior BJP leader.
The counsel, appearing for advocate-complainant Sirajin Basha, said that as the trial court order is not on record for now, the matter in the apex court should be adjourned.
SLP deferred
Allowing his plea, the court deferred hearing on the special leave petition filed by Basha against the Karnataka High Court order of November 2015 that had quashed the sanction by previous Governor H R Bharadwaj for prosecution of Yeddyurappa. K N Balraj, a co-complainant, had on February 19, 2016 filed the petition in the high court after present Governor Vajubhai Vala had also on December 4, 2015 declined the request.
The complainant had maintained that sanction for prosecution was not required under the Prevention of Corruption Act, but it was needed under the Indian Penal Code. The apex court on August 22, 2016 had asked the petitioner why he did not approach the trial court following after Vala declined permission for launching criminal proceedings against Yeddyurappa.
CAG gets time
The Supreme Court on Monday allowed a plea by the Comptroller and Auditor General (CAG) for more time to respond to Karnataka’s challenge against quashing of 15 FIRs registered against Yeddyurappa in cases relating to denotification of land. A bench of Justices A K Sikri and R K Agrawal granted two weeks time to the CAG after senior advocate Ashok K Panda sought time for filing its response.
The court put off the matter for further consideration after four weeks. In a special leave petition, the Karnataka government has contended that the CAG reports could be relied upon for initiating action for “cognisable offence” against Yeddyurappa.
